General terms and conditions for online ticket sales

These GENERAL TERMS AND CONDITIONS are mandatory and govern the relations of users with “Aquapark Sofia” EOOD, acting in its capacity as a trader who administers the website www.aquaparksofia.bg (the Site) and the online platform for purchasing tickets for visiting Aquapark Sofia – an attraction complex located in the city of Bankya, Sofia Municipality, Bulgaria.

Art.1 (1) These General Terms and Conditions for purchasing tickets electronically, hereinafter referred to as the “General Terms and Conditions”, apply to all contracts for the purchase and sale of tickets concluded electronically via the website www.aquaparksofia.bg, which is operated and maintained by “Aquapark Sofia” EOOD.

(2) www.aquaparksofia.bg is a virtual information resource on the Internet, created in accordance with the legislation of the Republic of Bulgaria, which is intended to provide users with up-to-date information about the activities of an attraction complex named “AQUAPARK SOFIA”.
(3) The Owner and/or persons providing any service on the Site are not responsible for problems in the provision of services due to inappropriate equipment of users, as well as incompatibility of the software applications used by them and the services provided on the Site.

I. INDIVIDUALIZATION OF THE MERCHANT
Art.2. (1) Electronic tickets are offered and sold through the sales system of “Aquapark Sofia” EOOD, hereinafter referred to in the General Terms and Conditions as the Owner, which company is a Bulgarian legal entity registered in the commercial register with the Registry Agency with UIC 205751266. The legal entity has its registered office and management address in the city of Sofia, 22 Kapitan Georgi Mamarchev Str., 1st floor, office 1.
(2) The Owner is a commercial company registered under the Value Added Tax Act.
(3) When selling electronic tickets, the Owner acts solely and exclusively in his own name and for his own account. The Owner does not offer or sell tickets or any other securities on behalf of a third party and/or for another person’s account.
(4) The address at which the Owner carries out his business activity does not coincide with the address of management specified in Art. 2, para. 1. The Owner carries out his business activity at the following address: Sofia region, Sofia municipality, Bankya city, Aquapark Sofia attraction complex.

II. MAIN CHARACTERISTICS OF THE TICKETS SUBJECT TO SALE
Art. 3. (1) The subject of the purchase and sale contracts concluded through the website www.aquaparksofia.bg are online tickets, which entitle their holder to visit and use all attractions, shops, restaurants, cafeterias and other commercial establishments, as well as all organized events and/or events for entertainment purposes /all referred to below for brevity as “attraction(s)”/, which are located and held in an attraction complex named “AQUAPARK SOFIA”, located in the city of Bankya, Sofia Municipality, Sofia District.
(2) The website www.aquaparksofia.bg publishes and announces the basic information about the attractions and services offered in “AQUAPARK SOFIA”. These are data on the opening hours of the same, the rules for access to the attraction complex, the name, technical data and the rules for use of the respective attraction, as well as any other useful and necessary information for users in this regard.
(3) The tickets sold do not, by their nature, constitute securities.

III. EVENT ORGANIZER
Art.4.(1) All facilities and events for which tickets are sold electronically via the website www.aquaparksofia.bg are organized by the Owner. The Owner is obliged to provide electronic ticket holders with both access to the “AQUAPARK SOFIA” attraction complex and the use of all attractions therein.
(2) The Owner determines the price of the tickets, as well as all other conditions under which the ticket holder has the right to visit the “AQUAPARK SOFIA” attraction complex and use its facilities. The Owner has the right to unilaterally make changes to the price of the vouchers, as well as to all other conditions related to access and use of the facilities in the “AQUAPARK SOFIA” attraction complex. The Owner shall announce any upcoming change in the relevant section of the website www.aquaparksofia.bg in a timely manner, ensuring that interested parties are aware of it.
(3) In the event that the Owner fails to fulfill its obligations in connection with the rights specified in Art. 3, Para. 1, the Owner shall bear the respective liability to the persons who purchased the vouchers in accordance with Section VI (Refund of the price paid) of these General Terms and Conditions.

IV. ORDER AND USE OF AN ELECTRONIC TICKET. METHOD OF PAYMENT
Art. 5.(1) By placing an order for an electronic ticket through the website www.aquaparksofia.bg, the client makes a statement of conclusion of a contract for the purchase of a ticket electronically.

V. ORDER AND USE OF AN ELECTRONIC TICKET. PAYMENT METHOD
Art.5.(1) By placing an order for an electronic ticket via the website www.aquaparksofia.bg, the client makes a statement of conclusion of a contract for the purchase of a ticket electronically within the meaning of the Electronic Commerce Act. This statement binds the client, and the order may be canceled or changed only in accordance with Section V (Cancellation of purchased vouchers) of these General Terms and Conditions.
(2) Each e-ticket has its own individual QR code, serial number, protection against counterfeiting, type of service, price, term, or a specific date for visit, as well as other useful data and/or information.
(3) The client receives his e-ticket to the email address specified by him in the format of a pdf file.
(4) To purchase an e-ticket via the website www.aquaparksofia.bg, customers must complete the following 5 steps:
Step 1 – selecting a ticket according to the information provided by the Provider on the types of tickets and services.
Step 2 – specifying and filling in the customer’s email address for receiving information and delivery of e-tickets. By specifying their email address, the user agrees that their IP address and any other information necessary for their identification will be recorded and, if necessary, provided to the relevant competent authorities, if requested.
Step 3 – consent to these General Terms and Conditions and Privacy Policy, and, if desired and agreed to receive marketing communications. According to the Electronic Document and Electronic Signature Act, when the above-mentioned website is accessed and the user expresses agreement with the General Terms and Conditions, he makes an electronic statement declaring that he is familiar with them, agrees and undertakes to comply with them.
Step 4 – payment method – payment for an e-ticket is made by debit or credit bank card under the payment terms specified in the commercial bank serving the Owner.
Step 5 – after a successful transaction, the client receives an e-ticket in pdf format to his/her email. The requested e-tickets are received within 24 (twenty-four) hours from the date of payment. The Owner’s system automatically sends an e-ticket. The e-ticket is specific information containing the data specified in Art. 5, para. 2, which the client receives to his/her email address in the form of a pdf file and which can be printed on any printing device. The QR code placed on each e-ticket contains all the information about the respective order. To ensure access to the attraction complex, the client is obliged to present his/her e-ticket in paper OR electronic format to the duly authorized employee. Otherwise, access and use of the attractions in the attraction complex will be denied.
(5) Customers can find a detailed description of each step on the Provider’s website www.aquaparksofia.bg, section BUY A TICKET.

Art.6. (1) Each visitor is obliged to keep their e-ticket until entering the attraction complex “AQUAPARK SOFIA”.
(2) By purchasing this ticket, the visitor undertakes to comply with all rules and regulations established by the Owner when accessing the complex and using the attractions and facilities.

Art.7. Minors (persons under 14 years of age) visitors to the “AQUAPARK SOFIA” attraction complex, in accordance with Art. 8, para. 3, para. 4, and para. 7 of the Child Protection Act and in connection with the provisions of the “Regulation on Specialized Protection of Children in Public Places, Minors and Underage Visitors to Public Places, Including Events”, must be accompanied by their parents, guardians, custodians or other adults who will take appropriate care of the child. Minors (persons over 14 years of age but under 18 years of age) are recommended to be accompanied by adult companions (parents, guardians, custodians or other adults who will take appropriate care of the child.

V. CANCELLATION OF PURCHASED E-TICKETS
Art.8. (1) The User has the right to cancel the purchased e-ticket within 48 (forty-eight) hours from the date of receipt of the e-tickets by e-mail. According to Art.10 of the Law on Electronic Documents and Electronic Signatures, the date of receipt of the e-voucher shall be considered by the parties to be the date on which an electronic statement sent by the Owner, which visualizes the e-tickets, was received in the electronic system specified by the User. If the User has not specified a specific information system, the statement is received upon its receipt in any information system of the addressee, and if the addressee does not have an information system – upon its download by the addressee from the information system in which the statement was received.
(2) The User shall notify the Owner of his/her wish to cancel the purchased e-tickets by sending an explicit written notification. The notification should include an e-ticket, its QR code, as well as the full names of its holder and the details of the latter’s bank account to which the price for its purchase should be refunded.
(3) The Owner shall refund the price within 30 (thirty) days, starting from the date on which he received the notification under Art. 8, para. 2.
(4) The User shall send his notification of cancellation to the Owner by e-mail to sales@aquaparksofia.bg
(5) The Owner shall refund to the User only the price indicated on the front of the e-tickets.

Art. 9. The provision of Art. 8 of the General Rules shall not apply to vouchers purchased up to 7 (seven) days before the deadline for using the same indicated on their front.

VI. RETURN OF THE PRICE PAID
Art. 10. (1) In case of impossibility to provide access to the attraction complex “AQUAPARK SOFIA” for a reason for which the Provider is responsible, the Provider is responsible for the return of the amounts paid for the e-tickets and for the compensation of the persons who suffered damages due to this impossibility.
(2) In these cases, the Owner shall refund to the customers the amount printed on the front of the e-tickets, as the refund shall be made in the following manner:
Remotely – by sending the e-tickets by courier to the address of the Owner’s management, specified in Art. 2, para. 2 of the General Terms and Conditions, in which case the customer must provide the Owner with a written statement with the bank account number to which the ticket price shall be transferred.
(3) In case of refusal of the Owner to refund the ticket price, the customers have the right to protect their interests according to the current Bulgarian legislation.

Art. 11. Instead of refunding the paid amount, the Owner has the right to offer its customers a replacement visit under the same conditions specified in the purchased e-ticket. The Owner is obliged to provide information about the replacement visit on its website at www.aquaparksofia.bg

Art.12. The Customer has the right to choose between the options specified in Art.10 and Art.11 of the General Terms and Conditions.

Art.13. The provisions of Art.10 and Art.11 do not apply, and the Owner bears no responsibility in cases of force majeure and force majeure.

VII. PROTECTION OF PERSONAL DATA
Art.14. /1/ The Owner applies Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and, in compliance with its legal obligations, takes the necessary technical and organizational measures to protect data from accidental or unlawful destruction or accidental loss, from unauthorized access, modification or dissemination, as well as from other unlawful forms of processing.
(2) By accepting these General Terms and Conditions, users and customers express their consent to the Owner collecting, processing and storing the personal data provided by them and using them for the purposes of fulfilling the concluded contracts for the purchase of tickets.

VIII. GENERAL PROVISIONS
Art.15. (1) The Owner is not responsible for the validity and authenticity of e-tickets purchased from a place other than the website specified in these General Terms and Conditions.
(2) In the event of an attempt at fraud, the e-ticket is considered invalid.
(3) The e-voucher is invalid if any part of it is lost, altered or destroyed.
(4) There is currently no additional online fee for the service of purchasing or booking an e-ticket.
(5) The user may not use the materials published on the website www.aquaparksofia.bg for personal needs, and their reproduction and distribution in any way for commercial purposes is prohibited without the written permission of the Owner.
(6) In connection with the use of the services provided on the website www.aquaparksofia.bg, the user is obliged: to comply with the provisions of these General Terms and Conditions and the legislation of the Republic of Bulgaria, to monitor for violations by other users of these General Terms and Conditions and the legislation of the Republic of Bulgaria and, if such violations are detected, to promptly notify the Owner through the specified contacts.

(7) The acceptance of these General Terms and Conditions by the client makes them an integral part of the contract for the purchase of tickets electronically, which is concluded between the Owner and the client by ordering tickets via the website www.aquaparksofia.bg
(8) These General Terms and Conditions may be amended unilaterally by the Owner, with the amendments coming into force upon their publication on the website www.aquaparksofia.bg, and users are deemed to have been notified of these amendments upon their publication on the said electronic site.
